правовая система, характеризующаяся тем, что основным источником права признаётся судебный Прецедент. Законы регулируют отдельные области отношений, но не сведены в единую систему, а всё, что не урегулировано законом, а также толкование законов, их применение определяются О. п. Действует в Великобритании (кроме Шотландии), США (кроме штата Луизиана), Канаде, Австралии, Новой Зеландии и некоторых других странах, бывших ранее английскими колониями и воспринявших английскую правовую систему. Первоначально О. п. сложилось в Англии в 13-14 вв. на базе местных обычаев и обобщения практики королевевских судов. Поскольку разбирательство в этих судах отличалось чрезвычайным формализмом, в 14 в. появилась параллельная система - т. н. Право справедливости. В 1873 О. п. и право справедливости были слиты в единую систему О. п., однако в теории и на практике сохраняется чёткое различие правовых институтов каждой из этих систем.

Характерным для О. п. является сочетание формализма с почти неограниченным усмотрением суда. Казалось бы, суд связан решением, вынесенным ранее по аналогичному делу судом той же инстанции или вышестоящим, но в огромном количестве прецедентов суд может выбрать именно те, которые подтверждают его позицию. Применяя изощрённые приёмы толкования прецедента, суд может, не отменяя установленного ранее правила, вынести решение прямо противоположное. В О. п. сохраняются правовые институты, терминология, сложившиеся в период его формирования, но используемые для регулирования отношений современные капитализма. Сохранение архаических форм, особого "юридического языка", необходимость ориентироваться в массе прецедентов делают О. п. практически недоступным для лиц, не обладающих специальной юридической подготовкой.

Характеризуя английское О. п., Ф. Энгельс писал: "Адвокат здесь всё; кто достаточно основательно потратил своё время на эту юридическую путаницу, на этот хаос противоречий, тот в английском суде всемогущ. Неопределённость закона повела, естественно, к вере в авторитет решений прежних судей в аналогичных случаях; этим она только усиливается, ибо эти решения точно так же взаимно противоречат друг другу..." (Маркс К. и Энгельс Ф., Соч., 2 изд., т. 1, с. 639).

В 40-50-х гг. 20 в. в Великобритании принято много законодательных актов, но это не умаляет значения О. п., поскольку применение закона и его толкование зависят в основном от суда.

В США и др. странах, воспринявших О. п., оно формируется в соответствии с общей доктриной, однако не все институты и формы, сложившиеся в Великобритании, включены в О. п. США и отдельных штатов, Канады и её провинций и т.п. В этих странах отброшены наиболее устаревшие формы, в них складывалось О. п., основывавшееся на прецедентах судов только данной страны, хотя в судебной практике нередки ссылки на английское О. п.
